Abstract

The paper examines the most significant rulings adopted in recent years by the Constitutional Court on the subject of new family models, from the perspective of the decision-making techniques employed by the Court to at least attempt to establish a dialogue with the legislator. A picture emerges of strong activism on the part of judges (including the Constitutional Court) in this area, counterbalanced by the substantial abdication of political decision-makers from fulfilling their proper role.
