The paper examines the APE sociale (the Italian social early retirement al- lowance) as extended to 31 December 2026 by Art. 1, §§ 162 and 163, of Act No. 199/2025, without substantive changes to the existing eligibility requirements. The analysis addresses the legal nature of the benefit – which occupies an intermediate position between social insurance and social assistance, financed entirely from general taxation and structurally distinct from a pension entitlement – and sets out its personal scope, as defined by the four categories of beneficiaries established by the 2016 founding legislation: involuntarily unemployed workers, family caregivers, disabled persons with a recognised reduction in working capacity of at least 74% and workers employed in arduous occupations. The contribution further examines the operational framework of the allowance, with particular attention to the rules on non-cumulation with employment income, the two-stage application procedure and the time windows for submission of claims, as well as the main interpretative issues arising in administrative practice and case law.
