Quale futuro per la prova biometrica? Riflessioni al crocevia tra garanzie dell’individuo e accertamento penale

This article explores the pitfalls of modern biometric recognition tools, whose unstoppable rise is aided by the now widely proven fallacy of human memory. Although the starting point is certainly not comforting, the use of technologies that are by no means worthy of blind faith seems likely to further undermine individual rights. While awaiting action by the domestic legislator, it does not appear that the recent AI Act is capable, beyond mere rhetoric, of ensuring that the use of FRTs truly respects the principles of proportionality and strict necessity, such as to prevent intolerable infringements of fundamental rights. On the domestic front, it is therefore necessary to raise the level of protection afforded, prohibiting the use of opaque algorithmic tools that do not allow a genuine control over how they work, in order to challenge their results. At the same time, care must be taken to avoid distortions in the traditional categories of evidence.

Il contributo esplora le insidie dei moderni strumenti di riconoscimento biometrico, la cui irrefrenabile ascesa è favorita dalla, oramai ampiamente dimostrata, fallacia della memoria umana. Sebbene il punto di partenza non sia certo confortante, l’impiego di tecnologie nient’affatto meritevoli di atteggiamenti fideistici sembra destinato a recare ulteriori vulnera ai diritti individuali. In attesa di un intervento del legislatore domestico, non sembra che il recente AI Act sia idoneo, al di là dei proclami, a garantirne un impiego realmente rispettoso del canone di proporzione e di stretta necessità, tale da non consentire intollerabili menomazioni dei diritti fondamentali. Sul fronte interno, si palesa quindi come doveroso un innalzamento del livello di garanzia accordato, che vieti l’uso di strumenti algoritmici opachi, sui quali non è possibile esercitare un reale contraddittorio tra le parti. Al contempo, occorre prestare attenzione al fine di scongiurare torsioni delle categorie probatorie.
