LA PARTECIPAZIONE “PARZIALMENTE SMATERIALIZZATA”: IL GRIMALDELLO DEL CONSENSO A FAVORE DELL’ECONOMIA PROCESSUALE

This article addresses the recent reform of Italian criminal justice which has, inter alia, affected the law governing remote participation via video link in criminal proceedings. While it is clear that the use of technology avoids the delay and upheaval associated with travelling to and from court, reducing the expenditure and disruption related to the transportation of prisoners in particular, it is equally clear that great care must be taken to ensure that defence rights are not impaired. It is argued that consent of the parties in order to enable defendants or witnesses to appear in court by way of a video link has the potential to amplify injustice, as it risks being to the detriment of less well-off defendants, who are more exposed to bartering between judicial authorities and the defence counsel.

Il contributo passa in rassegna le modifiche alla disciplina della partecipazione a distanza introdotte dalla riforma Cartabia. Se è evidente che l’uso dei collegamenti virtuali possa contribuire all’efficientamento della giustizia, nella misura in cui consente un risparmio dei costi di traduzione e di trasferimento, è altrettanto chiaro che occorre vigilare affinché non ne derivino menomazioni ai diritti difensivi. La possibilità di ricorrere al succedaneo della partecipazione virtuale subordinata al consenso delle parti rischia, infatti, di andare a discapito degli imputati meno abbienti, più esposti alle logiche di baratto tra autorità giudiziarie e difensore.
