Following Niklas Luhmann, my concern shall be to show the social and theoretical limits of the deontological view of morals which will uphold an absolute prohibition of torture. Without arguing for making torture legal, from the viewpoint of a public servant I shall defend the political as well as moral adequacy (justification) to consider exceptions to that prohibition for the case of “ticking bomb.”
