This paper examines negotiating strategies, the cultural context, and industrial relations terminology in the New York subway strike. A characterisation of the legislative framework was not found to be adequate to explain the dynamics of the dispute, but rather a discourse analysis approach was adopted, highlighting the contrast between the more confrontational discourse in the public domain (frontstage, in Goffman’s terms) and the more conciliatory negotiations, both formal and informal, taking place behind closed doors, (backstage).

The interdisciplinary nature of the study derives from the fact that the legal framework per se is not sufficient to provide an account of the moves between the players. Within the limits laid down by the legislative framework, a discourse analysis approach was found to be more effective in highlighting the dynamics of the dispute, with each party attempting to gain publc support for their negotiating position. The key objective of winning over the public defined the terms of the debate in the public domain, whereas negotiations behind closed doors were focused on reducing the duration of the dispute. The study may be said to have international implications since similar strikes occur periodically on the London Underground and the Paris Metro. In spite of the different institutional frameworks, the study may serve to cast light on negotiating processes leading to outcomes considered to be favourable by both parties to the dispute.
