This dissertation examines the Constitutional Court of the Russian Federation and its influence on religious freedom, focusing on how the Russian Orthodox Church and other “traditional” religions are systematically privileged while non-traditional groups face significant restrictions. Legal equality is preserved formally, but practical mechanisms of control reinforce disparities. The Russian Orthodox Church not only benefits from this framework but actively shapes it, embedding its priorities into the constitutional order. The research is organized in two parts. Part One analyzes constitutional limits and challenges to religious freedom in Russia, including the legal status of religious associations, collective rights of members, regulation of missionary activity, and distinctions between religious and extremist activities. Part Two investigates the Russian Orthodox Church’s influence on constitutional aspects of religious freedom, exploring its role in legislation and politics, cultural and non-material foundations, material influence over property, and the interplay between intra-Church law and freedom of conscience. The study concludes that the Russian Orthodox Church functions as a central actor in shaping Russian confessional policy, actively structuring legal and constitutional frameworks to favor traditional religions while constraining others.

La ricerca analizza la giurisprudenza della Corte costituzionale della Federazione Russa in materia di libertà religiosa, evidenziando come essa tenda a privilegiare sistematicamente la Chiesa ortodossa russa e le altre religioni “tradizionali”, imponendo al contempo notevoli limitazioni ai gruppi non tradizionali. L’uguaglianza giuridica tra le confessioni risulta dunque prevalentemente formale, poiché i meccanismi di controllo e di applicazione del diritto consolidano le disuguaglianze esistenti. Inoltre, la Chiesa ortodossa russa non è soltanto beneficiaria di tale assetto, ma parte attiva nella sua costruzione, inserendo le proprie priorità nel quadro costituzionale del Paese. Ne emerge così il ruolo della Chiesa non come soggetto passivo, ma come vero e proprio architetto della politica confessionale russa contemporanea.
