The contribution takes inspiration from a recent study to reflect on the possibility of using the paradigm of biopolitics, coined by Michel Foucault, for the purposes of better understanding the most recent transformative dynamics of administrative and public law in general. After having recalled the origins of that paradigm, the Author highlights how, in reality, recent developments once again define the role of the jurist and the way in which he behaves in the context of his dutiful action of reaffirming the central role of legal order.
