The purpose of this article is to outline the evolution of the internal discipline dedicated to non-scheduled public transport services, highlighting the critical aspects of the current regulatory framework, emerging in particular by comparing the approach of the legislator of the ‘Mini-reform’, on one side, with the interventions of the Constitutional Court, the case-law of the EU Court of Justice, the positions of the European Commission and the opinions of the independent administrative authorities, on the other.
