Un right to dialogue: verso il superamento del dualismo tra “dialogico” e “conflittuale”

Starting from the proposal of the Global Charter of Trieste for the right to dialogue, this essay takes into account the relevance of the category of the “dialogic” for the contemporary debate in order to assess the conditions to affirm its political-legal status. In this respect, we will deal with the epistemological implications of the concept of “right to dialogue” with regard to the disarticulation of monism, considered as an institutional paradigm, and to the field of effective exercise of rights in pluralistic societies. Within a critical approach to the Philosophy of Law, the article intends to focus on the interaction in its legal-theoretical and axiological value, on one side, and on the relational perspective, on the other side, as diagnostic tools and ways to overcome the heteronormativity connected to the stereotyping forms of the subject and to the altering processes.
