La tutela dei diritti linguistici nel contrasto all'antiziganesimo. Tra ordinamento italiano e spazio giuridico europeo

Starting from the case of the Italian legal system in the EU wider context, the essay focuses on the interaction between the linguistic issue and the anti-discrimination protection regarding the recognition of the rights of Roma and Sinti groups. Considering the legislative proposal n. 3162/2015 and the 2014 proposal based on the popular initiative in their profiles of compliance with the European Charter for Regional and Minority Languages (1992) and the Framework Convention for the Protection of National Minorities (1995) as well, the article aims to develop a reflection on the limits of a culturalized perspective. According to this approach, legally relevant subjective situations, individual and collective, are instrumentally traced back to supposed cultural specificities, whose protection is uncertain. As a matter of fact, cultural reductionism and essentializing perspectives, by assigning exclusive relevance to the housing issue, appear distant from the main European guideless in the fight against anti-Gypsyism.
