Obbligazione di sicurezza e nuove tecnologie: una lettura giuslavoristica del Decreto Smart Roads

The essay analyzes the implications deriving from the experimentation of self-driving vehicles on the protection of workers' health and safety. The investigation focuses, for the first part, on the analysis of the provisions of the decree of the Ministry of Infrastructure and Transport of 28 February 2018 with the aim of verifying how this discipline intersects with the employer's prevention obligations. A second part of the investigation verifies the adequacy of the insurance protection system against accidents in the event that the worker is the victim of an accident. The conclusions of the essay show that the current prevention and accident prevention system is adequate to protect the worker in the testing phases of self-driving vehicles but, at the same time, could show some critical profiles when the driverless car is open to the use of mass (and therefore also for use for work reasons).

Il contributo si propone di analizzare le implicazioni derivanti dall’attività di sperimentazione dei veicoli a guida autonoma sulla tutela della salute e della sicurezza dei lavoratori. Lo studio si sofferma, per una prima parte, sull’analisi delle disposizioni del decreto del Ministero delle Infrastrutture e dei Trasporti del 28 febbraio 2018 con la finalità di verificare come questa disciplina si intersechi con gli obblighi di prevenzione del datore di lavoro. Una seconda parte dell’indagine, invece, verifica l’adeguatezza del sistema delle tutele assicurative contro gli infortuni nel caso in cui il lavoratore resti vittima di un incidente. L’indagine approda alla conclusione che l’attuale sistema prevenzionistico e antinfortunistico sia adeguato a tutelare il lavoratore nelle fasi di sperimentazione dei veicoli a guida autonoma ma, allo stesso tempo, potrebbe mostrare dei profili di criticità quando la driverless car sarà aperta all’uso di massa (e quindi anche all’uso per ragioni di lavoro).
