A hundred years after the promulgation of the Charter of Carnaro, during the “Fiume Endeavor”, this essay aims to focus on the figure and the masterpiece of the sicilian jurist Tommaso Mirabella. Lawyer active in Palermo between the 1930s and the 1980s and lecturer at the Royal University of Palermo, Mirabella is the only scholar who has written a monograph entirely dedicated to the Constitution of Fiume. The document, a constitutional programme issued for the Italian Regency of the Carnaro, was drafted by the revolutionary trade unionist Alceste De Ambris (anti-fascist a few years later) with the assistance of the poet Gabriele d’Annunzio, who enriched the text by using his charming literary style. The Author analyses the Charter within the framework of the post-war constitutions, by emphasizing the most relevant innovations (such as corporations and social rights), and by connecting the Constitution of Fiume with the Italian labour Charter of 1927.

A cento anni dalla promulgazione della Carta del Carnaro, avvenuta durante l’“impresa di Fiume”, il presente saggio mira a far luce sulla figura e sull’opera principale del giurista siciliano Tommaso Mirabella. Avvocato attivo a Palermo tra gli anni Trenta e Ottanta del secolo scorso, libero docente presso l’Università di Palermo, Mirabella fu l’unico giurista a redigere una monografia interamente dedicata alla Costituzione di Fiume. Il documento costituzionale programmatico della Reggenza italiana del Carnaro fu redatto dal sindacalista rivoluzionario Alceste De Ambris (futuro antifascista) ed arricchita dall’elegante stile letterario del poeta Gabriele d’Annunzio. L’Autore analizza la Carta nel quadro del costituzionalismo post-bellico, evidenziando le innovazioni giuridiche più rilevanti (come il corporativismo e i diritti sociali) e ponendola in connessione con la Carta del lavoro del 1927.
