The study proposed and undertaken is developed around the objective of examining, from an interdisciplinary perspective, the level of compatibility between the institution of agile work and the context of public employment (given the current univocality of the reference legislation, applicable to both the public and private sectors). In an attempt to answer this research question - identified well before the pandemic events, in Italy and in the rest of the world, in the light of which the legal system has recognized new relevance to smart working - it was decided to distribute the reflection on three levels, of which the first, dedicated to the examination of the public context; the second, focused on the analytical study of the legal elements that define this new model of work organization, the third aimed at investigating the techniques and methods of evaluation of agile performance. In detail, the first chapter, entitled "The Regulatory Framework and the Context of Reference," opens with a detailed review of the terminological issues that continue to entertain labor doctrine since the enactment of Law No. 81/2017. The lexical examination introduces, in a functional manner, the study of the complex regulatory framework in force on the subject of agile work carried out on the employees of the pp. aa, built on the coordination between the rules contained in Legislative Decree no. 165/2001 and those of Law no. 81/2017, including the provisional changes introduced to this discipline to address the health emergency exploded in 2020. It follows, quickly tracing the essential stages of the long process of privatization of public work, undertaken in the early 90s, the study of the relevance assumed by the individual contract in labor relations with public administrations and how this aspect facilitates and incentivizes the use of flexibilization tools. In the final part, on the other hand, the theme of digitization is addressed, again in a diachronic perspective, which became even more relevant in the period of closure and distancing imposed to limit the risk of contagion during the pandemic. The second chapter, on the other hand, is entirely dedicated to the legal analysis of the constituent institutions of agile work. The analysis is divided into two sections: one aimed at studying the case in point, and therefore the essential and accidental elements that characterize it; the other, on the other hand, developed around the themes of security and social security. The third chapter, on the other hand, investigates the adequacy of the evaluation system with respect to the characteristics of agile work.

Lo studio proposto e intrapreso si sviluppa intorno all’obiettivo di esaminare, in un’ottica interdisciplinare, il livello di compatibilità tra l’istituto del lavoro agile e il contesto del lavoro pubblico (posta l’attuale univocità della normativa di riferimento, applicabile sia al settore del lavoro pubblico che a quello privato). Nel tentativo di rispondere a tale domanda di ricerca - individuata ben prima che, in Italia e nel resto del mondo, si avvicendassero gli eventi pandemici, alla luce dei quali l’ordinamento ha riconosciuto nuova rilevanza allo smart working – si è deciso di distribuire la riflessione su tre piani, dei quali il primo, dedicato alla disamina del contesto pubblico; il secondo, incentrato sullo studio analitico degli elementi giuridici che definiscono questo nuovo modello di organizzazione del lavoro, il terzo volto a indagare le tecniche e i metodi di valutazione della performance agile. Nel dettaglio, il primo capitolo, intitolato “Il quadro normativo e il contesto di riferimento”, si apre con una rassegna dettagliata delle questioni terminologiche che continuano a intrattenere la dottrina giuslavoristica sin dall’emanazione della l. n. 81/2017. L’esame lessicale introduce, in maniera funzionale, allo studio del complesso quadro normativo vigente in tema di lavoro agile svolto alle dipendenze delle pp. aa, costruito sul coordinamento tra le norme contenute nel d.lgs. n. 165/2001 e quelle della legge n. 81/2017, comprendendovi anche le modifiche provvisorie introdotte a tale disciplina per far fronte all’emergenza sanitaria esplosa nel 2020. Segue, ricalcando rapidamente le tappe essenziali del lungo processo di privatizzazione del lavoro pubblico, intrapreso agli inizi degli anni ’90, lo studio della rilevanza assunta dal contratto individuale nei rapporti di lavoro con le pubbliche amministrazioni e di come tale aspetto faciliti e incentivi il ricorso a strumenti di flessibilizzazione. Nella parte finale, invece, si affronta, sempre in una prospettiva diacronica, il tema della digitalizzazione, divenuto ancor più rilevante nel periodo di chiusura e distanziamento imposti per limitare il rischio di contagio durante la pandemia. Il secondo capitolo, invece, è interamente dedicato all’analisi giuridica degli istituti costitutivi del lavoro agile. L’analisi si divide in due sezioni: una, rivolta allo studio della fattispecie, quindi degli elementi essenziali e accidentali che la caratterizzano; l’altra, diversamente, sviluppata intorno ai temi della sicurezza e della previdenza sociale. Il terzo capitolo invece indaga sulla adeguatezza del sistema di valutazione rispetto alle caratteristiche del lavoro agile.
