The first two Chapters analyse the phenomenon 'hidden social dumping’ and circumscribe different forms and types of this social, economic and legal phenomenon arising in the new millennium. The third Chapter then examines Transnational Company Agreements (TCAs) as a possible tool to contrast and prevent 'hidden social dumping’ practices. The first Chapter embeds the newly developed concept 'hidden social dumping' in literature and develops a theoretical model for studying hidden social dumping along enterprises' supply and production chains. The second Chapter examines whether the (current) legal setting of intra-EU posting of workers leaves space for 'hidden social dumping practices' and critically assesses the impact of the revised Posting of Workers Directive 2018/957. The third Chapter then brings the analysis to the ‘non-legal’ sphere of CSR and examines whether Transnational Company Agreements (TCAs) can be an effective tool to contrast and prevent ‘hidden social dumping’ practices.

I primi due capitoli analizzano il fenomeno ‘hidden social dumping’ (il cosiddetto dumping sociale ‘nascosto’, ovvero ‘meno visibile’) e circoscrive diverse forme e tipologia in cui questo fenomeno sociale, economico e legale si manifesta nel nuovo millennio. Il terzo capitolo esamina gli ‘Accordi Aziendali Transnazionali’ (TCAs) come possibile strumento per contrastare questo fenomeno e prevenire al ‘hidden social dumping’. Il primo capitolo integra il concetto ‘hidden social dumping’ qui ideato in letteratura ed elabora un modello teorico per studiare la specifica forma di ‘hidden social dumping’ che si manifesta lungo le catene di fornitura (delle grandi imprese). Il secondo capitolo analizza il rapporto tra la normativa Europea sul distacco transnazionale e le pratiche di ‘hidden social dumping’ esaminando in particolare l’impatto della nuova Direttiva 2018/957 sul distacco transnazionale. Il terzo capitolo esamina se (e come) gli Accordi Aziendali Transnazionali possono essere uno strumento efficacie ed effettivo per contrastare le e prevenire alle pratiche di ‘hidden social dumping’ applicando la prospettiva ‘non-giuridica’ della responsabilità sociale d’impresa (RSI).
