In light of the current work situation, with employment rates showing high gender inequality, this doctoral thesis “Equal opportunities, work-life balance and inclusive work organisation: evolution, prospects for development and case study” addresses the issue of the promotion of equal opportunities in labour market participation through a balanced distribution of care-taking and work responsibilities between partners, with the aim of organising work in a more inclusive way. This thesis consists of three essays: the first provides an analysis of the evolution of European labour law in terms of gender discrimination, the second restricts the scope of analysis to the case of Italy, while the third focuses on a specific system in Italy, i.e. the judicial system. The first essay "Equal opportunities in EU labour law: from the principle of preferential treatment to the conciliation of working time and care-taking time" highlights how EU labour law has evolved over time to encourage equal opportunities in employment participation. The principle of equal treatment, which was initially intended as prohibition of discrimination of the most vulnerable groups and then developed into the principle of preferential treatment, is identified as the starting point of this evolution. Subsequently, the driving role of the European Pillar of Social Rights is discussed: this initiative was ground-breaking in that it placed the emphasis on work-life balance, intended as an incentive for women to enter and remain in the labour market and which laid the ground for the issue of Directive no. 1158/2019, which encourages a better distribution of responsibilities between partners. The second essay “Work-life balance in Italy. The progressive functional evolution of parental leave, from tool to support maternity through the sharing of family responsibilities between partners” brings parental leave to the centre of attention, investigating its innovative scope within the existing regulatory framework, from Law no. 1204 of 1971 to the unprecedented measures introduced by Law no. 53/2000, up to the reform of the Jobs Act and the recent measures implemented to respond to the Covid-19 emergency. The future reforms that are currently under discussion in EU Directive no. 1158/2019 and the new Italian “Family Act 2021” are also examined. In the third essay "The long road to gender equality: the case of the Italian judicial system", the question of equal opportunities in the world of work is explored, focusing on the judicial system. In its introduction, this work provides a reconstruction of the history of the regulatory path that led to the approval of Law no. 66 of 9 February 1963 entitled "Admission of women to public offices and jobs", which allowed women to access the judiciary, and points out the difficulties women have encountered to establish themselves in the system. Subsequently, the survey "Analysis of the current situation of the judicial system in the Emilia-Romagna region" is presented. The results of this survey, which was conducted by the Department of Economics and the Marco Biagi Foundation of Modena in collaboration with the Emilia-Romagna Section of the ANM (Italian Association of Judges), confirm and shed light on the persistence of forms of discrimination in the judicial system to this day. In addition to examining the issues emerging from the organisation of work in the judicial system, the survey identifies the main difficulty currently encountered by women in this sector of the labour market: work-life balance.

La Tesi di ricerca “Pari opportunità, conciliazione vita-lavoro e organizzazione inclusiva del lavoro: linee evolutive, prospettive di sviluppo e caso studio”, alla luce dell’attuale situazione lavorativa in cui i tassi di occupazione mostrano ancora una elevata disuguaglianza di genere a svantaggio delle donne, si interroga su come incentivare una partecipazione a pari opportunità nel mercato del lavoro, attraverso una equilibrata ripartizione delle responsabilità di cura e professionale tra i partner in ambito familiare al fine del raggiungimento di una organizzazione del lavoro più inclusiva. Il lavoro si articola in tre saggi: il primo analizza l’evoluzione del diritto europeo del lavoro in tema di discriminazione di genere, il secondo restringe l’ambito di analisi alla situazione italiana e il terzo focalizza l’attenzione su un settore specifico della situazione del nostro Paese, la Magistratura. Il primo saggio “Le pari opportunità nel diritto del lavoro dell’Unione europea: dal principio del trattamento preferenziale alla conciliazione tra tempi di lavoro e tempi di cura” rileva come il diritto europeo del lavoro si sia evoluto nel corso del tempo per favorire una partecipazione lavorativa a pari opportunità. Il punto di partenza è stato individuato nel principio di parità di trattamento, inteso inizialmente come divieto di discriminazione delle fasce più deboli ed evoluto poi nel principio del trattamento preferenziale. Successivamente, è stato commentato il ruolo propulsivo del Pilastro europeo dei diritti sociali innovativo nel porre l’accento sulla conciliazione vita-lavoro, intesa come incentivo per l’accesso e la permanenza delle donne nel mercato del lavoro e che ha originato l’emanazione della Direttiva n. 1158/2019 che incentiva una migliore corresponsabilizzazione tra i partner. Il secondo saggio “La conciliazione vita-lavoro in Italia. La progressiva evoluzione funzionale del congedo, da strumento di sostegno della maternità a mezzo di condivisione dei carichi familiari tra i partner” si propone di riflettere sul tema con riferimento allo strumento del congedo parentale, indagandone la portata innovativa all’interno del quadro normativo, dalla Legge n. 1204 del 1971, alle novità introdotte dalla Legge n. 53/2000, fino alla riforma del Jobs Act e ai recenti interventi emanati con l’emergenza Covid-19. Sono inoltre state prese in considerazione le ultime prospettive di riforma portate dalla Direttive Ue n. 1158/2019 e dal nuovo Family Act 2021. Nel terzo saggio “La lunga strada verso l’uguaglianza di genere: il caso della Magistratura italiana”, si approfondisce la questione delle pari opportunità nel mondo del lavoro, focalizzando sulla Magistratura. Lo studio, ricostruito il percorso storico normativo fino all’approvazione della Legge n. 66 del 9 febbraio 1963, rubricata “Ammissione della donna ai pubblici uffici ed alle professioni”, che ha consentito alle donne di accedere alla funzione pubblica della Magistratura, ed evidenziate le difficoltà che le stesse hanno incontrato per affermarsi nell’ordinamento giudiziario, accerta ed indaga sino al giorno d’oggi la persistenza di forme discriminatorie attraverso la realizzazione dell’indagine “Analisi della situazione attuale della Magistratura nella Regione Emilia-Romagna”, condotta dal Dipartimento di Economia e dalla Fondazione Marco Biagi di Modena, in collaborazione con l’ANM Sezione Emilia-Romagna, al fine di individuare la principale difficoltà che è attualmente riscontrata dalle donne in questo settore del mercato del lavoro. L’indagine ha individuato tale criticità principalmente nella questione della conciliazione vita-lavoro e ha approfondito le criticità emergenti dall’organizzazione del lavoro nell’ambito dell’ordinamento giudiziario.
