La retorica sui diritti dei minori e la responsabilità dei “maggiori”

This contribution calls into question the theoretical solidity of the so-called “rights of the children”, an approach which is claimed to be a piece of social rhetoric. The manifesto of this approach is the 1989 UN Convention on the Rights of the Child, which is shaped by the view of the child as an autonomous social actor. This view is radically rejected. The argument is shaped by the thesis that minors are in a condition of vulnerability. After rejecting the traditional logical relation between rights and duties, the argument emphasises the existence of an indirect relation between the two concepts, which are linked together through the conceptual chain “value-commitment-responsibility-duty”. This chain binds children, adults and the institutions around them.

L’articolo pone in questione la consistenza teorica dei c.d. “diritti dei minori”, evitando di seguire la retorica pubblica usata nel trattare di tali diritti. Il suo manifesto è la Convenzione ONU sui diritti del fanciullo del 1989, che si basa sulla concezione del bambino inteso come attore sociale autonomo. Rigettando questa concezione e partendo dalla condizione di vulnerabilità dei minori, il lavoro non tratta il problema secondo la prospettiva tradizionale della relazione logica diritti/doveri, ma pone in evidenza l’esistenza di una loro relazione indiretta, mediata dalla catena concettuale “valore-impegno-responsabilità-dovere”, che lega i minori e i “maggiori” intorno a loro.
