SEPTIES IN IDEM. DALLA «MATERIA PENALE» ALLA PROPORZIONE DELLE PENE MULTIPLE NEI MODELLI ITALIANO ED EUROPEO

The study deals with the subject of “criminal matter” together with that of the double jeopardy, analyzing the Italian sanctioning system of the multiplication of both criminal and administrative sanctions for the same basic conduct, and comparing it with the European case-law of ECHR and CJEU. The scientific fragility of ne bis in idem applied to the “matière pénale” is strengthened in view of the need for an overall proportion of the sanctioning response. The Italian system, which knows up to at least seven afflictive (partly punitive) penalties for the same fact, alongside the model of the sanctioning degradation (progressive reduction of the punishment), requires a thinning of the san- ctioning system (civil, criminal and administrative all together). The meaning of what is or is not “criminal” stays in the focus of the analysis carried out.

Lo studio affronta il tema della materia penale unitamente a quello del ne bis in idem sostanziale, conducendo l’analisi sul sistema sanzionatorio italiano della moltiplicazione delle sanzioni in primo luogo penali, ma anche amministrative, per la medesima condotta di base, e confrontandolo con la giurisprudenza europea di Corte edu e CGUE. La fragilità scientifica del parametro del ne bis in idem applicato alla “matière pénale” si rafforza in prospettiva di esigenza di proporzione comples- siva della risposta sanzionatoria. Il sistema italiano, che conosce sino ad almeno sette sanzioni afflittive (in parte punitive) per il medesimo fatto, accanto al modello della degradazione sanzio- natoria (ridotta punibilità progressiva), necessita di uno sfoltimento sanzionatorio di sistema (civile, penale e amministrativo insieme). Il significato di ciò che è o non è “penale” resta al centro dell’analisi compiuta.
