STARGATE. «LATTE NON TRACCIATO, LATTE MAL CONSERVATO» [ART. 5, COMMA, 1, LETT. B), LEGGE N. 283/62]

In matters regarding criminal offenses of food law, the approach taken by the case-law of the Supreme Court has contributed, over time, to transform the provision under Art. 5, Paragraph 1, Lett. b), Law of 30 April 1962, n. 283, into a regulation that is quite different from the typical one. Starting from there hermeneutical initiatives, the Third Section of the Supreme Court of Cassation recently stated that the use of an untraced res material makes the final product as being «in a condition of poor state of conservation», pursuant to Art. 5, Paragraph 1, Lett. b).

In materia penale alimentare, l’atteggiamento della giurisprudenza di legittimità ha contribuito, nel tempo, a trasformare la disposizione di cui all’art. 5, comma 1, lett. b), l. 30 aprile 1962, n. 283, in una norma del tutto diversa da quella tipica. Partendo da queste iniziative ermeneutiche, la III sezione della Corte di cassazione ha di recente affermato che l'utilizzo di una materia prima non tracciata rende il prodotto finale rilevante ai sensi dell'art. 5, comma 1, lett. b).
