The focus of the present study is the analysis of the ius prohibendi in the ancient co-ownership in Roman law and the evolution of this institute from classical to the justinianic period; starting from the ancient, juridical sources the author's purpose is to show the difficult evolution of the action for the division (actio communi dividundo) and the role of the prohibitio in it.
